Alimony

Alimony

Although many believe differently, alimony can be awarded to a spouse in New Hampshire if the Court finds sufficient evidence to grant it.  Additionally, in some cases, alimony can be used to facilitate a divorce settlement on a negotiated basis, for example, alimony is tax deductible to the person paying it and considered taxable income to the person receiving it.  In considering if alimony is appropriate in a divorce or legal separation matter, the Court must first determine the financial need of the party requesting alimony as well as the financial ability of the other party to pay it.  The Court also will consider the lifestyle to which the parties have become accustomed to during their marriage.
